1. Agreement to Terms
These Terms of Service (“Terms”) govern your access to and use of the Nosnas Marketing website (nosnasmarketing.com), our social media accounts, our mobile/desktop integrations, and the digital marketing services, digital products, and content we provide (collectively, the “Services”). By accessing our website, purchasing a service, downloading a digital product, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
If you are using the Services on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Services
Nosnas Marketing is a digital marketing agency. Depending on what you’ve engaged us for, our Services may include:
- Search engine optimization (SEO) and local SEO services
- Website content creation, including articles and landing pages
- Social media content creation and posting (including our “Nosnas Bot” automated content service) across platforms such as Facebook, Instagram, YouTube, and TikTok
- Google Business Profile audits, guidance, and related content
- Monthly retainer arrangements covering a combination of the above
- One-time client projects (such as website or local SEO work)
- Free and paid digital products, guides, and checklists
- Affiliate marketing content, where we may earn a commission for products or services we mention (see Section 8)
The specific scope of services for any paying client is governed by the individual agreement, invoice, or order confirmation between that client and Nosnas Marketing, which takes precedence over this general description in the event of a conflict.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to enter into a services agreement with us or make a purchase. Our website and general content are not directed at children, and we do not knowingly collect information from anyone under 13.
4. Accounts and Client Information
If you provide us with information to deliver a service (business details, login credentials, marketing materials, or similar), you agree that the information you provide is accurate and that you have the right to share it with us. You’re responsible for maintaining the confidentiality of any credentials you provide to us and for any activity that occurs as a result of sharing them with us for the purpose of performing the Services.
5. Payment, Retainers, and Subscriptions
- Retainer and subscription services (including monthly retainer arrangements and the Nosnas Bot content service) are billed on a recurring basis, typically monthly, until cancelled by either party in accordance with the terms agreed at signup.
- One-time projects are billed according to the agreed project scope and payment schedule.
- Digital products are billed at the time of purchase.
- Unless otherwise stated in your specific agreement, fees are non-refundable once work has begun or a digital product has been delivered/accessed.
- We reserve the right to change our pricing for future billing periods with reasonable advance notice to active clients.
6. Cancellation
Recurring services may be cancelled by either party according to the notice period specified in your service agreement. If no specific notice period was agreed upon, we ask for at least 30 days’ written notice (email is acceptable) to allow for an orderly wind-down of active work.
7. Intellectual Property
- Our content: The Nosnas Marketing website, our original articles, guides, checklists, templates, graphics, and other materials we create are owned by Nosnas Marketing (or licensed to us) and are protected by copyright and other intellectual property laws. You may not copy, resell, or redistribute our original content without our written permission.
- Client deliverables: Unless otherwise agreed in writing, content we create specifically for a paying client as part of a service engagement (such as website articles, social posts, or ad copy for that client’s business) becomes the property of that client upon full payment for the applicable work.
- Your content: If you provide us with your own logos, photos, business information, or other materials to use in your marketing, you retain ownership of that material, and you represent that you have the right to give it to us for that purpose.
8. Affiliate Marketing and Sponsored Content
Some of the content we publish — including blog articles, social media posts, and videos — includes affiliate links or promotes third-party products and services for which Nosnas Marketing may receive a commission or other compensation. Where required, this content is disclosed with hashtags or notices such as “#ad” or “#sponsored.”
Our opinions and recommendations regarding third-party products are our own. We are not responsible for the products, services, terms, or actions of any third party we mention or link to, and your use of or transactions with any third party are solely between you and that third party.
9. Third-Party Platforms and Links
Our Services involve posting to and interacting with third-party platforms, including Facebook, Instagram, YouTube, TikTok, LinkedIn, and Google Business Profile. Your use of those platforms is governed by their own respective terms of service and privacy policies, which we do not control. We are not responsible for changes those platforms make to their features, policies, or algorithms that may affect the performance or availability of content we post there.
10. Disclaimers
THE SERVICES AND ANY CONTENT OR MATERIALS PROVIDED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee specific results from our marketing, SEO, or social media services, including but not limited to search rankings, traffic, leads, follower counts, engagement, or revenue. Marketing and search engine outcomes depend on many factors outside our control, including third-party platform algorithms, market conditions, and competitor activity.
11. Limitation of Liability
To the fullest extent permitted by law, Nosnas Marketing and its owner(s) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from the Services will not exceed the amount you paid to Nosnas Marketing for the specific service giving rise to the claim in the three (3) months preceding the claim.
Nothing in these Terms is intended to limit liability in ways not permitted under applicable law.
12. Indemnification
You agree to indemnify and hold Nosnas Marketing harmless from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, or content or materials you provide to us that infringe the rights of a third party.
13. Termination
We may suspend or terminate your access to the Services if you violate these Terms. Either party may terminate an ongoing service arrangement in accordance with Section 6 above.
14. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms. For material changes affecting active clients, we will make reasonable efforts to provide direct notice.
15. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles, unless otherwise specified in an individual client agreement.
